San Francisco’s Ban the Box law, known as the Fair Chance Ordinance, prohibits employers from inquiring into applicant conviction history on applications before extending a conditional employment offer. The San Francisco Ban the Box law also includes posting and notice requirements.
The San Francisco OLSE, the agency tasked with San Francisco Ban the Box law enforcement, recently released the 2020 Ban the Box Law Official Notice. San Francisco employers with at least five employees must post this notice at every workplace, job site, or other San Francisco location under the employer’s control frequently visited by its employees or applicants. When applicable, employers must send this notice to each labor union.
San Francisco employers that do not comply with the Ban the Box law’s notice requirements may face penalties.
